The research “The (mis)paths of school management in the municipal school system of Balneário Camboriú (1996–2020)” is part of the research on Formative Processes and Educational Policies of the Postgraduate Program in Education of the Federal Institute Catarinense –IFC . The promulgation of the 1988 Constitution was the legal framework that guaranteed, for the first time, democratic management of Brazilian education, replacing traditional management based on the models of business administration. The Law of Guidelines and Bases of National Education–LDBEN (1996) and the National Education Plans (2001; 2014) regulate this management model. Based on the legal frameworks, the objective is to analyze whether the proposals for school management, applied in the municipal school system of Balneário Camboriú, from 1996 to 2020, are characterized as democratic/participatory management. The research is characterized by a qualitative approach and for data collection we used documentary and field research. To learn how legislation and discourses on democratic/participatory management works in the school context, it is necessary to understand the dynamics of this process. For this purpose, school management in the municipality of Balneário Camboriú will be analyzed through the view of  specialists (administrators, advisors and supervisors) who are directly involved in school management. The field research was carried out in the municipal education system, through the application of a questionnaire to approximately 101 specialists.To answer the research problem, the text is organized as follows: introduction, definition of the problem, justification, objectives and methodology. In section 2, are present the historical course of educational policies in administration/management school, before and after the 1988 Constitution and indicative of democratic management in the municipalities of Santa Catarina. In section 3, we historicized school management in the municipality through government plans of elected mayors and legislation, to identify proposals related to school management and how they are configured. In section 4, based on studies and references in the area (Paro (2010; 2015); Libâneo (2012); Lück (2009; 2017); Militão (2015); Fraiz (2013), among others), the meaning and characteristics of democratic/participatory school management. At section 5, we analyze democratic/participatory management in the view of education specialists in the municipality of Balneário Camboriú, showing the way it is established in schools. Finally, we synthesize the (mis)paths and the possible paths for the realization of democratic/participatory management as public policy for the municipality of Balneário Camboriú. Initial results indicate that, despite the legislation providing that education should be taught based on the principle of democratic management still, in the present day, the issue of control, imprisoned in the hands of directors, it's practice. It is the principal (not elected by the school community) who controls and oversees the actions of the entire school and the power and authority are installed in a subtle way, revealing a management that does not contemplate or in a limited way, the democratic and participative practice.
