Education from a critical perspective constitutes a strong ally for the realization of emancipatory, integrative and re-socializing educational processes. The practice of education is of fundamental importance for the necessary transformations and resignifications in the way of thinking, acting and relating to people. Consequently, able to fulfill the social function of education, with regard to the formation of people with effective social quality. Prison education, historically constituted as a precarious educational offer, has undergone significant changes over the last decades in the Brazilian context. Discussing public educational policies in the context of deprivation of liberty in Brazil is to think of an excluding system. When approaching the issue of educating in prison, we usually deal with a phenomenon that is loaded with various stigmas that make the provision of education even more precarious. Currently, the educational proposal needs and must be carried out not only as a training, but with a perspective articulated to social interaction and as a promoter of change in the lives of the people served by it. From this perspective, this study, entitled "Public Policies for the education of prisoners as a guarantee of the right to education", developed in the line of research Training Processes and Educational Policies of the Graduate Program in Education (PPGE/IFC), presents the following question advisor: how the notion of guaranteeing the right to education is present in the National Legislation and in the Legislation of the State of Santa Catarina, as well as in the productions of the Graduate Program in Education of the Federal University of Santa Catarina (UFSC) when it comes to education of incarcerated? Therefore, this study aims to analyze the notion of guaranteeing the right to education present in the National Legislation and in the Legislation of the State of Santa Catarina, in the productions of the Graduate Program in Education of the Federal University of Santa Catarina (UFSC) when it comes to incarcerated education. Methodologically, the approach of this study will have a qualitative character, as it approaches a universe of meanings where issues such as democracy, training, autonomy, restriction of freedom and human rights are the target. We emphasize that, in terms of procedures, we rely on documentary research, as we consider that using documents in research should constitute a procedure to be recognized. The legislation has a range of information from which proposals for building society in a broad manner and guaranteeing rights in a specific way can be unveiled. In the case of this research, analyzing the legislation will make it possible to broaden the understanding of the notion of guaranteeing the right to education present in the National Legislation and in the Legislation of the state of Santa Catarina with regard to the education of inmates. In the perspective of dialogue between the state and national context, an analysis of dissertations and theses was produced that address the issue of education in the context of deprivation of liberty as a right, in the last 10 years (2011-2021) in the productions of the Graduate Program in Education at the Federal University of Santa Catarina (UFSC). From the initial search movements, it is possible to affirm that the volume of productions justifies the need to expand the discussion about incarcerated education.
